Trademarks (service marks)

Legal protection of a trademark in the Russian Federation is provided subject to its state registration, upon which a trademark certificate is issued. Verbal, graphical, three-dimensional and other designations, or combinations thereof, may be registered as trademarks.

  An exclusive right for a trademark remains in force for ten years from the date of filing an application for state registration and may be extended for ten years. The validity period of an exclusive right for a trademark may be extended an indefinite number of times.

A trademark may be registered for the name of a legal entity, or a natural person engaged in entrepreneurial activities.

Prior to filing an application to the Federal Service for Intellectual Property, Patents and Trademarks (ROSPATENT), we recommend a preliminary examination of the claimed designation for assessment of its compliance with criteria of the current Russian Federation legislation. The examination is performed in databases of filed applications for trademarks and trademarks in effect in the Russian Federation territory.

Following the search, we execute a report, in which, the search results considered, we assess the possibility to register the designation in the form suggested by the applicant. Based on the search results, we issue recommendations on ways of adjusting the claimed design, as well as the list of goods and services for the trademark to be registered.
